ORDER TERMS & CONDITIONS
A. DEFINITIONS
“Website” or “Site” means www.shop.baligiftware.com is owned and operated by Bali Giftware based in Denpasar Bali INDONESIA (hereinafter referred to as "we," "us," or "the Company").
“User”, “Customer”, “Buyer” or “You” hereinafter referred to as anyone using and/or visiting the website for any purpose.
This document (these "Order Terms and Conditions") is a legally binding agreement between you (including the organization that you represent, if any) and the Company.
All orders and contracts are subject to these Order Terms & Conditions. Before ordering any item through us please read these Order Terms & Conditions carefully. By placing an order with us, then this shall be deemed conclusive evidence of your acceptance of these Order Terms & Conditions.
We reserve the right to change these Order Terms & Conditions from time to time without affecting the existing Order Terms & Conditions including any special or varied terms and conditions accepted by you upon purchase. Any changes to these Order Terms & Conditions will be effective on the day they are posted on our website. You must ensure that they keep up to date with any of these updated versions of these Order Terms & Conditions.
B. THE PRODUCTS
- All items displayed on the website are made to order. We don't stock any items.
- Some items can be ordered in single quantities and some of them have to be ordered in minimum quantities.
- We strive to display as accurately as possible the true colors of our products in the marketing materials provided and through the website, but we cannot guarantee the accuracy of the photographs.
- We reserve the right to alter any specification or finish of the items on website without prior notice.
- You are aware that our products are handmade; therefore you agree that you may receive products that are slightly different from one piece to another. Slightly differences can occur in patterns, decorations, shapes and shades of color. That is the beauty and uniqueness of handmade products and we do not accept this as a reason for defect.
- The items such as furniture and handicraft s are made from natural wood and wood veneers, accordingly appearances may vary. Some woods, particularly teak, can mellow in colour with age and exposure to sunlight. You are buying handmade furniture and handicrafts where varying degrees of distressing may apply from piece to piece; this may involve wood splits, wood cracking, wood filling, knots, spots, scratch marks, antiquing etc.
- All dimensions of items specified are approximate and are used as a guideline. We cannot guarantee the complete accuracy of the dimensions that are shown on our website/promotion materials and will not accept dimensions as a reason for defect.
- Certain products may require assembly. You must follow the assembly instructions carefully and use professional installers when necessary. All furniture products must be inspected periodically to ensure that all screws, nuts, bolts, and other fasteners are properly maintained and secure.
C. PRICES
- Prices are quoted including shipping cost and are valid for two weeks, after two weeks the prices may change without prior notice.
- We strive to ensure that all prices quoted are correct and within the company's pricing structure. In the event that an incorrect price is quoted, we shall amend such price upon notification. We are under no obligation to supply any product that is priced incorrectly.
- You bear the import duties and other costs that may occur in the destination country.
D. ORDER PROCESS
- The process of ordering the products can be done online through the website or via email.
- All items listed on the website are specifically made to order. We do not stock any items.
- After we received your full payment we start to produce your order. Production lead time varies according to the quantity and type of items ordered, which is around 7 to 14 days.
- We reserve the right to accept or reject any order placed, without assigning any reasons whatsoever.
E. PAYMENT
- At the time we receive your order, we will immediately send you a price quote for confirmation.
- For order value less than US$1000, a full payment is required to process your order. As for the order value of more than US $ 1000, a 50% deposit is required to start production, balance payment after the goods are finished.
- Payment can be made using Credit/Debit cards and Bank Transfer. Customer bears the transfer fees
- The amount stated on the invoice is the net amount we must receive. Customer bears the transfer fees and local bank charges of each transfer made.
- A week before completion of your order we will notify you by email and request the remaining payment (if any).
- Should the remaining payment not be received within 14 working days after email notification of order completion is sent, then the order is considered to be null and void. All deposits have been paid will be utilized to defray costs associated with your order.
F. SHIPPING & DELIVERY
All the items listed on the website are specifically made to order. We do not stock any items.
After we received your full payment we start to produce your order. Production lead time varies according to the quantity and type of items ordered, which is around 7 to 14 days.
- Shipping:
All items will be shipped directly to you from our fulfillment center in Bali Indonesia to all destination countries. The delivery timeframe may vary according to the destination and the shipping option used. On average, orders shipped by express shipping will arrive to the destination address in 1-2 weeks and 4-6 weeks with regular shipping. - Shipping Rates:
We use a fixed rate cost to ship our items to all our international customers from Bali Indonesia. The rates are based on the item weight, volume and the country's location zone. - Packaging:
When we process orders, we strive to ensure the safest packaging for shipping. We always pack orders using a lot of protective materials to avoid damage to the items in transit, but ultimately we are not responsible for any damage to the product box or packaging. Unless the actual product is damaged then no claim will be accepted for damage to the box or packaging of the product. - Order Tracking:
When You will receive an email confirmation to let you know that your order is being processed and a confirmation of shipment of your order including tracking number. In some cases an order may be split into different packages and you will receive 2 or more tracking numbers. As a result, some items may not ship together or ship on the same day. This is due to weight restrictions for regular shipping imposed by the post office or courier. - Custom & Taxes:
For international shipment may be subject to import taxes or customs duties levied by the destination country that must be fulfilled by the customer. However, we will declare your order as a "Gift" in the customs declaration to exempt from these charges but we cannot guarantee it. All countries have their own laws regarding the import and taxes of certain products. We have no control over these charges and cannot provide estimates for import taxes for individual countries as they all differ from country to country. Please note that understanding import restrictions and the payment of any associated import customs and taxes is the responsibility of the customer. We recommend you contact your local customs office for current charges before placing your order. - Loss & Missing Shipment:
We are not responsible for lost or stolen packages since are happening more and more often due to the prevalence of online retail. However, we will do everything we can to help recover a package.
If a package has been noted as delivered, we are unable to file an insurance claim as this is "Proof of delivery." If your package is missing, but tracking shows that the package is still in transit, then we can file a claim to locate this package or get compensated for the lost merchandise and shipping costs. Please note that at certain times of the year and during weather advisories, packages can be delayed for more than 14 days in transit. Please contact us and we will get started with contacting the delivery service to help locate your package. It is your responsibility to make sure that you enter the shipping address correctly. We cannot be responsible if a package is shipped back to us due to an incorrect or undeliverable address.
G. CANCELLATION
No cancellations are accepted once order has been confirmed, and all the payments or deposits have been paid will be utilized to defray costs associated with your order.
H. RETURN & REFUND POLICY
We want you to be completely satisfied with each and every purchase. However, please note that we are a family-owned small business, supporting small artisans and local communities with small batch production. So please respect our need to have a restricted return and refund policy.
Also as you may have been aware of that all items are handmade, slight variations in size, color, slight cracks in furniture etc. is the expected and natural result of the "handmade" process, which makes it unique. We do not accept these conditions as reasons for defects, returns or refunds (as stated in point B 5-7 above).
- Immediately upon receipt the shipment you should properly inspect the goods.
- Claims for damaged or shortage must be notified to us by email within 5 (five) working days of receipt of the shipment.
- Failure to notify us in time may result in the rejection of a claim, as we must file a claim with the shipping service within one week of receipt of the shipment.
- Claims must be supported with clear photographs that show the damages: clear photographs of the packaging to demonstrate condition of packaging and details of damages of item (s).
- Please contact us for a Returned Merchandise Authorization (RMA) number, Return Center details, and specific return instructions.
- You make delivery for returned item(s) to the given Returns Center address using a traceable shipping service (such as EMS, UPS, FedEx, TNT, or DHL) and it is strongly recommended that you insure the package as you will be responsible that all returned items arrive at the Returns Center in their original condition. Please include all original packaging, tags, receipts, and the gift wrap.
- Store Credit or Refunds for returned item(s) will be issued within 5 (five) business days of receipt of the returned merchandise. Refunds are made through Payoneer. If you don’t have a Payoneer free account please click here to create one.
- You will be deemed to have received the goods unconditionally if no claim is made within 14 days of receipt of the shipment.
- IMPORTANT NOTES AND RESTRICTIONS:
a). No refunds or store credit will be available if no return notification is made after 5 (five) days of receiving the package.
b). Store credit or refunds will not be issued if the returned products have been damaged or altered in any way before arriving at the Returns Center.
c). We are not responsible for any costs incurred (including freight, duties and taxes, or import fees) on returned items.
d). We are not responsible for lost items that are returned without an RMA number or sent to an address other than the Return Center specified by us.
e). Shipping costs are non-refundable. If you receive a refund, the cost of shipping will be deducted from your refund.
f). The gift box charges are not refundable.
g). No refunds or returns on gift orders and custom orders.
h). No refunds or returns on gift certificates.
i). As a safeguard against potential abuse, we reserve the right to refuse refunds to anyone who has made what we determine to be excessive returns.
I. FORCE MAJEURE
We shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, accidents, war, fire, strikes, lock outs, failure of any communications including telecommunications or computer systems, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and we shall be entitled to a reasonable extension of its obligations.
J. GOVERNING LAW & JURISDICTION
These Order Terms & Conditions shall be interpreted, construed and enforced in accordance with Indonesian law and shall be subject to the exclusive jurisdiction of the Indonesian courts.
